What Makes a Will Valid in California

To be legally binding in California, a will must meet specific requirements:

Written - California recognizes only written wills (handwritten or typed).
Capacity - The person creating the will (the testator) must be at least 18 years old and of sound mind, understanding the nature and extent of their property and the people who will inherit.
Voluntary - The testator must create the will freely, without undue influence, duress, or fraud.
Witnesses - The will must be signed by the testator in the presence of at least two competent witnesses, who also sign the will.
Signature - The testator’s signature (or a mark made in their presence) is required to validate the will.
