Why Estate Planning in California Can’t Wait

Without a valid estate plan, California’s intestate succession laws determine how your assets are distributed. Those rules follow a fixed formula that has nothing to do with your actual relationships or intentions. A longtime partner, a stepchild, or a close friend receives nothing unless documents say otherwise.

California probate is a public court process. Under California Probate Code Section 10810, statutory fees are calculated as a percentage of the gross estate value, not its net worth, so a heavily mortgaged property still generates a large fee. The process often takes 12 to 18 months before beneficiaries receive distributions. A revocable living trust can help assets transfer privately without probate court involvement.

Without a durable power of attorney or advance healthcare directive, a California court may need to appoint a conservator to manage your financial and medical affairs if you become incapacitated. That process adds cost and can delay decisions at the moment when speed matters most. Blended families, business interests, and real property held in both Los Angeles and Ventura counties add further complexity to an unplanned estate.

When to Create or Revisit Your Estate Plan

Many Conejo Valley residents have documents in place but haven’t reviewed them in years. Life changes faster than estate plans are updated. We recommend a review every two to three years even when no major event has occurred, and immediately when any of the following apply:

Marriage, divorce, or remarriage affecting beneficiary designations or trust terms
Birth or adoption of a child or grandchild requiring guardian designations
Death or incapacity of a named trustee, executor, or healthcare agent
Purchase or sale of California real property, or property acquired in another state
