The 120-Day Deadline Every Will Contestant Must Know

Under California Probate Code §8270, a will contestant has 120 days from the date the will is admitted to probate to file a challenge. Courts enforce this cutoff strictly, and missing it can generally bar a claim permanently. No-contest clauses add another layer of risk: under California law, a no-contest clause can strip a challenger of any inheritance they’d otherwise receive if the court finds the challenge was brought without probable cause. That combination of deadline pressure and penalty risk makes early legal assessment an important step you can take.

Grounds for Contesting or Defending a Will in California

California law recognizes specific grounds on which a will may be challenged, and those same grounds define what a defense must address. Only parties with legal standing may bring or oppose a will contest: beneficiaries named in the will, people named in an earlier version, and heirs who would inherit under California’s intestate succession laws if the will were invalidated. On the defense side, named beneficiaries, executors, and the estate itself may all have standing to uphold the document.

Recognized grounds for contesting a will under the California Probate Code include:

Lack of testamentary capacity: The testator didn’t understand what they were signing, the nature of their assets, or who their heirs were at the time of execution.
Undue influence: Someone in a position of power or close access pressured the testator into changing their estate plan in a way that reflects the influencer’s wishes rather than the testator’s own.
Fraud or forgery: The document was falsified, or the testator was deceived about what they were signing.
Improper execution: The will wasn’t signed before at least two witnesses as California law requires.
Revocation: A later, valid document supersedes the will being offered for probate.

No-contest clauses deserve close attention before any challenge is filed. A clause of this kind can eliminate a beneficiary’s inheritance if they contest the will without probable cause, which makes pre-filing legal assessment essential.

The no-contest clause risk runs in the opposite direction: a challenger who proceeds without probable cause may lose whatever inheritance they would have received under the challenged will. Acting before the probate case opens, or immediately after it does, can preserve the broadest range of options for both those considering a challenge and those preparing a defense.
